Changes regarding directed unpaid leave during shutdown periods commencing 1 May 2023

Shut down periods: Change to Employer’s Right to Require Employees to take Unpaid Leave

The Fair Work Commission has, as part of its four yearly review of Modern Awards ([2022] FWCFB 246) decided that the Fair Work Act 2009 does not permit Award-covered employees to be directed to take unpaid leave for a temporary shutdown period (such as from Christmas to New Year) where that employee has insufficient accrued paid annual leave to cover that period.

Although this decision was handed down as part of a review of Modern Awards, the FWC considered sections 93 and 94 of the Fair Work Act 2009, and so the decision will also prevent Award-free employees from being required to take unpaid leave during a shutdown.

A new model term has been handed down, for inclusion in 78 modern awards which contain clauses regarding shutdowns. The awards affected by this change are listed below.

The new model clause will take effect from 1 May 2023. However, as comments in the ruling state that there is currently no power in the Fair Work Act to require an employee to take unpaid annual leave, this prohibition will have immediate effect.

The result of the ruling is that an employer is no longer able to require an employee to take annual leave during a shut down period, if that employee has insufficient accrued annual leave to be paid during that period.

The options for an employer are;
• Finding the employee alternative duties during the shutdown
• Where an employee has accrued rostered days off, or time off in lieu of overtime (TOIL) then the employee may be required to take this paid time off during the shutdown,
• The employee may be granted advance annual leave with the above being subject to the terms of the applicable Award and the employee’s contract of employment.
• That an employer and employee may by agreement, recorded in writing, agree that the leave be unpaid, for example, if the employee plans to take an extended holiday and does not wish to use up annual leave during shut down. Neither the employee nor the employer have the right to decide this unilaterally, without the agreement of the other.

Further, the ruling confirms that employees are to be given 28 days’ notice, in writing, of a period of shut down, although a shorter notice period may be agreed between the employer and a majority of employees. However, the notice may be a longer period in certain awards, where this is appropriate, or where a longer period of notice already applies in that Award.
